Disability Services agreements and awards **Download the Disability Services Log of Claims 2009 (PDF 850KB)**AEU members in disability services work in three distinct types of service, each with its own conditions and sources of funding. Conditions for many members have changed following the introduction of the new Modern Awards on January 1, 2010. Day services (funded by the Victorian State Government) are covered by a variety of agreements with employers. They also come under the new Social Community, Home Care and Disability Services Industry Award (DOC, 430KB). They used to come under Part 1 of the old Disability Services Award. Sheltered employment services are funded by the Commonwealth Government and fall under the new Supported Employment Services Award (DOC, 400KB). A handful of employers have agreements with the AEU or with their staff, but most do not. These services were formerly covered by Part 2 of the DSA. Employment services, also funded by the Commonwealth, are also covered by Supported Employment Services Award (DOC, 400KB). They used to be Part 4 of the DSA. A handful have agreements with the AEU or with their staff. Day servicesThe majority of Day Services employers have made agreements with AEU. Most cover the period 1 July 2006 to 30 June 2009. The AEU has begun negotiations for a new agreement for the sector. A log of claims (PDF 850KB) has been served on employers in the form of a draft agreement. Other agreements survive from earlier negotiating rounds in 1999 and 2005. If your employer has an individual enterprise agreement you can readily find its text by searching on the FairWork Australia website. For agreements made during the WorkChoices era (the vast majority of agreements presently in force) you will need to go to another search engine on the FairWork Australia website. Workers in these services not covered by an agreement are covered by the Supported Employment Services Award. The award rates of pay were set by the now defunct Australian Fair Pay Commission. The current and previous Australian Fair Pay Commission pay rates can be found on the FairWork Australia website. Most employees of sheltered employment or employment services should be paid the rates set out in those documents. |
